The Ntcheu Senior Resident Magistrate Yohane Munthali, on Wednesday February 03, convicted and sentenced a 24-year-old man to serve 21 years imprisonment with had labour for defiling a six year old girl at Chatchuka village in Traditional Authority Ganya, in October last year.
The state, through Inspector Samie Liwonde, told the court that the accused person, James Hadson, was a servant to the victim’s parents.
Inspector Liwonde continued to enlight the court that on this day the victim, in the company of others, went to Livulezi river to bath.
Claiming that he is also there to wash his clothes, it is this time that the accused took advantage of the environment to fulfill his mission on the young soul.
When the same accused brought the victim home from the said river, mother to the victim became suspicious with the way the girl was looking.
This forced her to do a thorough check on the girl which later revealed some clues that she might have been defiled.
Ntcheu District Hospital medical examination confirmed the defilement on the girl.
When the accused knew that he has been identified that he is the one responsible, and that the matter has already reached Kandeu Police Unit, he disappeared into thin air since that day.
It was up until December 13, 2020 when he was spotted in area.
Members of the community policing forum apprehended the accused and handed him to police.
In his submission, Inspector Samie Liwonde, asked the court to hand the accused with stiff punishment.
He cited the age of the victim, and the trauma he has caused to the young soul, saying it will hunt her for the rest of her life.
Liwonde, continued to submit that being a servant at the victim’s home, it is a proven fact that the accused had a plan in place to victimize the girl despite knowing that she is too young to be taken as a wife.
The state also said that defilement cases, which contravene section 138(1) of the Penal Code, have reached at an alarming rate, hence need to hand perpetrators of such acts with huge sentences.
In mitigation, Hadson, asked the court to be lenient when passing its sentence.
He told the court that he is a first offender, and that he has some responsibilities at home.
Passing his sentence, Senior Resident Magistrate Yohane Munthali, quashed the mitigating factors.
Munthali was in agreement with what the state submitted.
He then slapped the accused with 252 months imprisonment to deter other would be offenders.
James Hadson, hails from Kambewa village, Traditional Authority Ganya in the district.
Ntcheu District, registered 98 sexual related cases last year that include 76 defilement cases.
This means that the cases increased rapidly in 2020, compared to 56 and 36 cases respectively registered in 2019.
