Businessman Joshua Chisa Mbele failed to produce a passport in court as one of the conditions demanded by the State in his bail application.
Mbele was arrested on Tuesday and has been charged with two counts of illegal publication of names contrary to section 87 of the electronic transaction act and second criminal libel.
He pleaded not guilty to both charges.
Appearing before Senior resident Magistrate Wanangwa Nyirenda, Mbele through his lawyer Gilbert Khonyongwa applied for bail.
Khonyongwa argued that his client’s continued detention is tantamount to pre-trial punishment.
State Prosecutor Ledson Mangani did not object to the bail application but said it should be granted on condition that Mbele’s freedom of expression be limited.
He further asked the Court that the accused should surrender his traveling documents.
However, Khonyongwa told the court that Mbele’s passport is not in his possession.
He said the passport is in South Africa with his wife who is processing payments from the banks.
Magistrate Nyirenda has reserved his ruling to tomorrow morning.
He was arrested following his Facebook post of a fake document with alleged names of top government officials implicated in Zuneth Sattar’s corruption case.
